The Employees' State Insurance Corporation has invited applications for empanelment as Panel Advocates in two Regional Offices at once — Himachal Pradesh and West Bengal. Between them the two notifications carry 106 tentative slots: 46 in Himachal Pradesh and 60 in West Bengal.
Both close on 21 August 2026 — and this is a physical application, not an email one.
Himachal Pradesh accepts applications until 5:30 p.m., West Bengal until 6:00 p.m., on the same date. The application has to reach the Regional Office in the prescribed format, by post or by hand. If you are reading this when it is published, you have roughly a week, and you should be working backwards from the courier's delivery time rather than from the deadline.

The Two-Tier Experience Rule — Read This First
The single most important thing in both notifications, and the thing most readers skim past, is that the experience requirement is not one number. It is tiered by forum. A great many advocates read "10 years" and stop, when the tier that actually concerns them is the five-year one.

If you were enrolled in 2021 or earlier, you clear the five-year tier. That tier covers the Employee Insurance Courts, which is where the bulk of ESIC's routine litigation actually sits — contribution disputes, coverage questions, benefit claims and prosecutions under the ESI Act, 1948. For a practitioner five or six years into a district practice, this is a realistic entry point into government panel work, and it is a far better fit than waiting until you have ten years for a High Court slot.
Where the Two Notifications Differ
These are two separate notifications issued by two Regional Offices of the same organisation, and they are not identical. The differences are worth knowing before you draft either application.
1. West Bengal contemplates Supreme Court work; Himachal Pradesh does not. The West Bengal notification expressly requires Advocate-on-Record status for Supreme Court matters wherever such empanelment is required, and sets ten years for the Supreme Court, the High Courts and the various benches of the Central Administrative Tribunal. The Himachal Pradesh notification stops at the High Court. If you are an AoR, the West Bengal panel is the one that has a place for you.
2. Himachal Pradesh states desirable qualifications; West Bengal does not. The HP notification says that experience in handling Labour Law cases is desirable, and that an LL.M. will be preferred. Neither appears in the West Bengal notification. If you are applying to Himachal Pradesh and you have either, put it on the first page of your application rather than burying it in an annexure.
3. West Bengal reserves an express relaxation power; Himachal Pradesh does not mention one. The West Bengal notification states that the Director General, ESIC may relax or modify eligibility conditions in appropriate cases for reasons to be recorded in writing.
On that relaxation clause — be realistic.
It is a genuine discretion and it is recorded in the notification, so a candidate marginally short of the threshold is not automatically out. But it is a discretion, not an entitlement. It is exercised by the Director General, for reasons recorded in writing, in appropriate cases. Do not build an application on the assumption that it will be exercised in your favour. If you are relying on it, say so expressly and give the Corporation a concrete reason — a specialised ESI practice, reported matters, a subject-matter expertise the panel needs.
The Requirement Nobody Prepares For
Both notifications carry the same clause, and it is the one that quietly screens out otherwise eligible applicants:
"The applicant should have sound professional reputation, good communication skills and adequate office infrastructure such as accessible office/chamber, staff and communication facilities."
An advocate who practises out of a shared table in the bar room, with no chamber address and no support staff, meets every other condition and fails this one. If you have a chamber, describe it in the application — the address, the fact that it is accessible, the staff you employ, a landline or dedicated number, an email address you actually monitor. This is not a formality. ESIC needs a panel advocate who can receive a brief, be reached at short notice and file on time, and the clause exists because that has been a problem.
What the Work Involves
Panel advocates for ESIC handle the Corporation's litigation across the forums for which they are empanelled. In practice that means:
• Proceedings before the Employees' Insurance Court constituted under Section 74 of the ESI Act, 1948 — the specialised forum for disputes on coverage, contribution, and entitlement to benefit.
• Recovery and contribution matters, including challenges to determinations under Section 45A.
• Prosecutions under Sections 84 to 86 of the Act.
• Writ petitions and appeals arising from the above in the High Court.
• Service and establishment matters, which is why the West Bengal notification names the CAT benches.
It is statutory and largely repetitive work, and that is its attraction for a junior-to-middle practitioner: the volume is steady, the law is a defined field you can genuinely master, and a few years on an ESIC panel builds a labour and social security practice that is difficult to build any other way.

Use the prescribed format annexed to the respective notification. An application on your own letterhead is not a substitute, and empanelment notices of this kind are routinely rejected at the scrutiny stage for format alone. Attach proof of enrolment with the State Bar Council, proof of the years of practice you are claiming, and documents for the desirable qualifications where you have them.
One Thing I Could Not Verify
The fee schedule.
The single question every applicant wants answered — what a panel advocate is actually paid per case, per appearance and per conference — is set out in ESIC's Standard Guidelines for Empanelment of Advocates, which are annexed to the official notifications. I attempted to retrieve both official PDFs while preparing this post and the ESIC servers did not respond. Rather than guess at figures, I am telling you plainly that you should read the schedule of fees in the notification itself before you apply. It is the term that will decide whether the engagement is worth your time, and it is not something to take on trust from any summary, including this one.
Who Should Apply
If you were enrolled in 2021 or earlier, practise in the district courts or before the Employees' Insurance Court in either State, and have a functioning chamber, you meet the criteria and you should apply. The five-year tier is where the realistic opportunity lies, and with 106 slots across the two regions the field is wider than a single-post recruitment.
If you have ten years and a High Court practice, both panels are open to you. If you are an Advocate-on-Record, West Bengal is the notification that provides for Supreme Court work.
And if you are two or three years short, read the West Bengal notification's relaxation clause, and make a considered decision about whether you have something specific enough to justify asking for it.
The deadline is 21 August 2026. Both applications go by post or by hand. Do not leave the courier to the last two days.
